In the latest move of their long-running patent dispute, New Zealand-based medical device manufacturer Fisher & Paykel Healthcare has filed a patent infringement proceeding in the Federal Court of Australia against ResMed, the Australian manufacturer of products for the treatment of sleep disorders, and several of its related companies.
F&P alledges that four ResMed producs infringe its patents. It is seeking a range of remedies, including damages and injunctions preventing the manufacture and sale of these products by ResMed in Australia.
“Over the past 45 years we have made a considerable investment in our research and development programme and built up a significant patent portfolio. We take the infringement of our intellectual property rights very seriously and we will continue to take whatever action is necessary to protect our investment,” said F&P managing director and CEO Lewis Gradon.
